These general terms and conditions of sale apply to all sales concluded on the doc2tech.fr website

The Doc2tech website sells all products, spare parts and accessories from the following brands: Apple, Samsung, Microsoft, Nokia, Sony LG, HTC, BlackBerry, Asus, Huawei, Xiaomi, Wiko.
The customer declares that they have read and accepted the general terms and conditions of sale prior to placing their order. Validation of the order therefore constitutes acceptance of the general terms and conditions of sale.

The company Doc2tech reserves the right to adapt or modify these terms at any time, the version of the general terms and conditions of sale applicable to any transaction being the one available online on the doc2tech.fr website at the time of the order.

At Doc2tech.fr, we offer you services such as the repair of smartphones, tablets and computers, with a one-year warranty* on all our repairs, except for batteries which come with a 6-month warranty* (excluding breakage, oxidation or mishandling). We have specially designed our prices to be among the most competitive and affordable on the market, while guaranteeing unrivalled quality and unique expertise acquired over our 12 years of experience. Our commitment is to provide our customers with affordable repair solutions, without compromising the quality of our eco-responsible services.

1. The Customer

The Customer declares that they are a natural person, at least 18 years of age, and have the legal capacity or hold parental authorisation enabling them to place an order on the site. When entering their personal data in the “my account” section, the Customer must ensure the accuracy and completeness of the mandatory data they provide. In the event of an error in the recipient's details, Doc2tech cannot be held responsible for any failure to deliver the product. Doc2tech reserves the right to cancel any order when the customer's IP address is located in a country different from the billing and/or delivery address.

2. Content

The purpose of these general terms and conditions is to define the rights and obligations of the parties in connection with the online sale of goods offered by the seller to the buyer, via the doc2tech.fr website
These terms and conditions only apply to purchases made on the Doc2tech website and delivered exclusively to mainland France or Corsica. For any delivery to the French overseas territories or abroad, please contact us directly.
These purchases concern the products, spare parts and accessories of the following brands: Apple, Samsung, Microsoft, Nokia, Sony LG, HTC, BlackBerry, Asus, Huawei, Xiaomi, Wiko.

3. The legal guarantee of conformity

This warranty applies independently of the commercial guarantee. The conformity warranty thus covers product-related defects if: the product is unfit for the use ordinarily expected of a similar product, or if the product does not match the description given on the site. To claim this warranty, the customer must inform doc2tech.fr (by email or telephone) of their intention to enforce the warranty. The customer has one year from the moment they took possession of the product. The customer therefore undertakes to return the product to doc2tech.fr so that it can be assessed in order to determine the product's conformity. The cost of returning the product is borne by the customer. Where the warranty applies, the shipping costs will be refunded to the customer in the form of a credit note, and the product may be exchanged or refunded to the customer in the form of a credit note. Refunds will also be issued as a credit note for trade customers.

3.2. The guarantee against hidden defects

Doc2tech also provides a guarantee on products with a hidden defect. The guarantee covers technical defects that may affect the proper functioning of the product, for faults appearing some time after installation. The guarantee cannot be applied if the customer has misused the product, namely oxidation, broken glass or mishandling. Likewise if the product shows so-called "normal" wear and tear. This will therefore void the guarantee. The risk of loss or damage to the products is transferred to the customer at the moment they take physical possession of the products in accordance with the provisions of article L.138-4 of the French Consumer Code. To claim this guarantee, the customer has one year from the discovery of the fault or defect, and the customer must inform Doc2tech by email or by telephone of their intention to apply the guarantee, and must return the product promptly. The customer therefore undertakes to return the product to Doc2tech together with the contact form available on the website, so that it can be assessed in order to determine the origin of the product fault. The cost of returning the product is borne by the customer. Where the guarantee applies, the shipping costs will be refunded to the customer in the form of a credit note, and the product may be exchanged or refunded only upon prompt receipt. The refund will be issued as a credit note for professional customers.

3.3 Product availability

The company Doc2tech does not manufacture any goods or finished products.

4. The order

Placing an order on the Site is subject to compliance with the procedure put in place by the company Doc2tech, made up of a series of different steps that the customer must follow in order to validate their order. The buyer has the option of placing their order online, from the online catalogue and using the form provided, for any product, subject to available stock.
The buyer will be informed of any unavailability of the product or item ordered.
For the order to be validated, the buyer must accept these general terms and conditions by clicking in the place indicated. They must also choose the delivery address and method, and finally confirm the payment method.
The sale will be deemed final once the seller has sent the buyer confirmation of acceptance of the order by email and once the seller has collected the full price.
Any order constitutes acceptance of the prices and of the description of the products available for sale. Any dispute on this point will be handled within the framework of a possible exchange and of the warranties mentioned below.
In certain cases, in particular non-payment, an incorrect address or another problem with the buyer's account, the seller reserves the right to block the buyer's order until the problem is resolved.

The customer has access to all personal information and information relating to orders placed on the site in their customer account. The customer will also be able to find there the details of their purchases as well as the related invoices.

4. Price and payment terms

4.1. Price determination

Product prices are shown in euros, all taxes included, excluding the contribution to shipping costs. The total price of the order (all taxes and shipping costs included) is shown in the basket. doc2tech.fr reserves the right to change its prices at any time, but products will be invoiced on the basis of the rates in force at the time the order is placed, subject to availability.

4.2. Promo codes and special discounts

Promotional discount codes applicable to all or certain specific purchases made on doc2tech may be offered at any time. Any conditions of use additional to these terms of use will be specified at the time the discount code is issued (in particular the period of use of the code). In order to use a promotional code, the user must log in to their personal doct2tech account, which they will have previously created. A discount code cannot be used after placing an order. A maximum spending amount, before discount, may be specified when the code is issued. If the promotional code has expired, the customer will not be able to use it. We cannot accept any liability and will have no obligation to replace a promotional code if it is lost or used by a third party, since the code will then be cancelled.
If a promotional code is offered on the doc2tech.fr website and does not work correctly as a result of fraud, falsification, a technical error or anything else beyond our control that affects the operation, administration, security and clarity of the promotional code, we reserve the right to cancel, modify or suspend it.
Promotional codes are non-transferable and cannot be exchanged for money. If the customer receives a promotional code, it may only be used by them on the doc2tech.fr account, for the reasons for which it was issued. It is essential to keep it confidential and not to share it with third parties (for example, on social media or on a forum). If, at the time of payment for the order or retrospectively, we notice any misuse of promotional codes in any way (for example, by selling them to others), we reserve the right to cancel the promotional code and/or suspend or close the doc2tech.fr account without prior notice.

4.3. Payment terms

Products are payable in full on the day the order is placed. Payment for purchases is made either by:
– Bank card: The Customer accesses a dedicated area provided by a banking institution, which ensures the security and recording of the payment order. In this respect, the Customer expressly acknowledges that providing their bank card number to doc2tech.fr constitutes authorisation to debit their account up to the amount of the ordered products. It is also possible to pay in 3 instalments free of charge up to a limit of 500 €.
– Bank cheque: The company reserves the right to refuse bank cheques.
– Bank transfer: The company's bank details (RIB) are displayed to the customer when they opt for this payment method. Receipt of the transfer will validate proper payment of the order, its preparation and its dispatch. The data recorded and stored by Doc2tech constitutes proof of the order and of all transactions carried out. The data recorded by the payment system constitutes proof of the financial transactions.
– SEPA direct debit: SEPA direct debit is not currently available.

5 – Product availability – Delivery

Except in cases of force majeure or during periods when the online shop is closed, which will be clearly announced on the site’s home page, the dispatch times, subject to available stock, will be those indicated below. Dispatch times run from the order registration date indicated on the order confirmation email. If the ordered product is unavailable, the buyer will be informed as soon as possible and will have the option to cancel their order. The buyer will then have the choice of requesting either a refund or an exchange of the product directly.

After confirmation of the order and subject to full payment of the price of the ordered products, Doc2tech undertakes to ship the ordered products to its customer at the delivery address indicated on the order. Delivery times are 2 to 7 days by tracked or registered letter in France. By Colissimo in France, allow 48h to 72h, and by Chronopost: 24h working hours.
Weekends and public holidays are of course not taken into account.

No claim will be accepted if the times below are met by the delivery service(s).

In the case of an automatic reshipment due to an address fault (incorrect address, door code not provided, letterbox not accessible, no name on the letterbox), the buyer will have to pay new shipping fees, whether these were initially free or partly chargeable.
In the event of a delivery delay compared with the date initially set, the buyer must report it by email to the company doc2tech.fr, in order to improve the quality of service that may be offered to them and to allow the seller to carry out an investigation with LA POSTE.
An investigation with the POSTAL SERVICE may take several working days. If the product is found during this period, it will be immediately re-dispatched to the home of the buyer or of the recipient designated on the order form.
If, on the other hand, the ordered product is not found at the end of the investigation period, Doc2tech will, at its own expense, re-ship the products ordered by the buyer.
However, if the buyer is pressed for time, they may then reorder their order again at their own expense. If the first shipment is eventually delivered, they must refuse it so that it is returned to Doc2tech. And if, at the end of the investigation period, neither the buyer nor doc2tech has received the first shipment, then a refund will be made for the amount of the initial order.

6 – Right of withdrawal

The private or business customer has a legal right of withdrawal, which they may exercise without giving any reason (without undue delay), within the legal period from delivery of the order, exercised by returning at their own expense the new products (in their original packaging) together with the order no. and the form to the following address: doc2tech – 12 Avenue de la République – 75011 Paris – France.

6.1. Product withdrawal for exchange

Upon receipt of the parcel and after confirming that it is in full working order (brand-new condition), doc2tech.fr undertakes to exchange the customer's product. Return shipping costs are to be borne by the customer. If the withdrawal concerns a non-conforming product, the customer must refer to article 3.2. The spare parts returned must imperatively be in as-purchased, brand-new condition: protective films intact, tapes not removed, no signs of use (glue or wear marks). In the event of depreciation of the product resulting from mishandling or improper use by the customer, the exchange will not be granted. The customer will be notified of this by e-mail.

6.2 Product withdrawal or exchange for refund

Upon receipt of the parcel and after confirming that the products work properly (product in new condition), doc2tech.fr undertakes to refund the full value of the product to the customer solely in accordance with article 6. The refund will be issued as store credit for professional customers. Return shipping costs are to be borne by the customer. The spare parts sent back must imperatively be in their original purchase condition: protective films intact, tapes not removed, no signs of use (glue or wear marks). In the event of depreciation of the product resulting from mishandling or misuse by the customer, the refund will not be granted. The customer will be notified by e-mail.

The private or business customer has a legal right of withdrawal, which they may exercise without giving any reason (without undue delay), within the prompt legal period from delivery of the order, exercised by shipping at their own expense the new products (in their original packaging) together with the order no. to the following address: L’atelier du Smartphone: 12 Avenue de la République – 75011 Paris – France.

6.4 Withdrawal on refurbished phones

Refurbished phones are sold as second-hand goods. The statutory withdrawal period is identical to that of a new product. When returning an item, the customer must justify their cancellation and provide the IMEI number of the phone sent. No warranty will be honoured in the event of breakage of the phone or a fault related to use (jailbreak or replacement of a spare part of the phone). A refurbished smartphone can only be refunded by way of a replacement or a credit note.

7. Device repair

By accepting these general terms and conditions, the customer warrants that they are the owner of the device brought in for repair and that they are a natural person of legal age, over eighteen years old.
The customer acknowledges and accepts that the device they bring in for repair may still be under manufacturer’s or seller’s warranty and could be repaired free of charge by the latter, whereas the repair carried out by doc2tech.fr is chargeable.
The customer acknowledges and accepts that the intervention of doc2tech.fr on their device will void the warranty of the device’s manufacturer and/or seller. doc2tech.fr cannot be held liable for this.
The buyer confirms that they are the owner or have obtained the owner's permission to carry out the transfer of the data contained in the device. The buyer confirms that the product is not the subject of any theft or loss report. The buyer acknowledges that the personal data contained on their product(s) complies with the laws and regulations in force in France, that they remain the sole owner and as such are responsible for it, and that Doc2tech.fr cannot under any circumstances be held liable.
The buyer is informed that doc2tech.fr is an independent trader and cannot be equated with a repairer approved by the manufacturers.
Furthermore, any device that has already been dismantled or oxidised will not be accepted by the technical department.

7.1 Repair directly in store

– When the customer brings their device in for repair at the shop, the doc2tech.fr technician checks that the device is on the list of devices they are able to repair, then carries out a diagnosis of the problem.
– Doc2tech reserves the right to refuse to carry out any service if it cannot be performed in accordance with professional standards.
– Doc2tech accepts no liability in the event of loss of data stored on the device entrusted to it. It is the customer’s responsibility to make the necessary backups before any work is carried out by Doc2tech.
– Once the repair has been completed, the device will be returned to the customer after payment of the repair price.

7.2 Repair via the internet

– The device must be sent with a tracking number and properly protected (small box, bubble wrap, etc.), failing which Doc2tech accepts no liability for the loss of or damage to the device.
– The device must be sent with the repair form completed and signed by hand by the customer. However, if the customer has made an error when filling in the form regarding the device model, and we receive no response from them within several days despite our technician following up, the device will be returned to the customer in its original condition.
– For any payment by cheque or bank transfer, the repair will only be carried out once payment has been received.
– Doc2tech accepts no liability for the loss of data stored on the equipment entrusted to us. It is the customer's responsibility to make the necessary backups before any intervention by doc2tech.fr
– In the event of an error on the customer's part regarding the device model or the choice of repair, or should the technician be unable to repair the device, doc2tech undertakes to return the device and refund the full repair amount, excluding the device's shipping costs.
– Once the repair has been completed, the device will be sent back to the customer via Chronopost as an express home delivery or to a Chronopost pickup point.

8 – Refund – Resolution

Refunds for products in the cases referred to in Articles V and VI will be made by doc2tech.fr after receipt of said products in good condition. The refund will be made using the same payment method chosen by the customer at the time of their order. The company reserves the right to change the refund method if the original payment method is not compatible with the refund. Refunds will be made in the form of a credit note for professional customers.

In the event of failure to comply with the agreed delivery date or deadline, the buyer must, before terminating the contract, require the seller to fulfil it within a reasonable additional period of ten days.
Failing performance by the expiry of this new period, the buyer may freely terminate the contract.
The buyer must complete these successive formalities by registered letter with acknowledgement of receipt or in writing on another durable medium.
The contract will be deemed terminated upon receipt by the seller of the letter or written notice informing them of this termination, unless the professional has performed in the meantime.
The buyer may, however, terminate the contract immediately if the dates or deadlines mentioned above constitute an essential condition of the contract for them.
In this case, when the contract is terminated, the seller is required to refund the buyer for the entire amount paid within the legal time limit.
In the event that the ordered product is unavailable, the buyer will be informed as soon as possible and will have the option to cancel their order. The buyer will then have the choice of requesting either a refund or an exchange of the product.

9 – Force majeure

Any circumstances beyond the parties’ control preventing the performance of their obligations under normal conditions are deemed grounds for release from the parties’ obligations and result in their suspension.
The party invoking the circumstances referred to above must immediately notify the other party of their occurrence, as well as of their cessation.
The following shall be considered cases of force majeure: any irresistible facts or circumstances external to the parties, unforeseeable, unavoidable, beyond the parties' control and which could not be prevented by them despite all reasonably possible efforts. Expressly, in addition to those usually recognised by the case law of the French courts and tribunals, the following shall be considered cases of force majeure or fortuitous events: the blocking of means of transport or supply, earthquakes, fires, storms, floods, lightning, the shutdown of telecommunications networks or difficulties specific to telecommunications networks external to customers.
The parties will come together to examine the impact of the event and agree on the conditions under which the performance of the contract will continue. If the case of force majeure lasts longer than three months, these general terms and conditions may be terminated by the injured party.

10 – Intellectual property

The content of the website remains the property of the seller doc2tech, the sole holder of the intellectual property rights to this content.
Buyers undertake not to make any use of this content; any total or partial reproduction of this content is strictly prohibited and may constitute an offence of counterfeiting.

11 – Data Protection and Privacy

The personal data provided by the buyer is necessary for processing their order and issuing invoices.
They may be passed on to the seller’s partners responsible for the fulfilment, processing, management and payment of orders.
The processing of information provided through the doc2tech.fr website has been declared to the CNIL.
The buyer has a permanent right of access, modification, rectification and objection regarding the information concerning them. This right may be exercised under the conditions and according to the procedures defined on the doc2tech.fr website.

12. Governing law

Any order automatically entails the customer's acceptance of the Terms and Conditions of Sale. These terms and conditions of sale are governed by French law. The competent court is the district court (tribunal d'instance) for disputes whose amount is less than or equal to 10,000 € or the regional court (tribunal de grande instance) for disputes whose amount exceeds 10,000 €. This applies to substantive rules as well as to procedural rules. In the event of a dispute or complaint, the buyer shall first contact customer service to obtain an amicable solution.

13 – Protection of personal data

Data collected

The personal data collected on this site is as follows:
– account creation: when the user's account is created, their surname; first name; email address; telephone number; postal address;
– login: when the user logs in to the website, it records, in particular, their surname, first name, login data, usage data, location data and payment-related data;
– profile: the use of the services provided on the website allows a profile to be completed, which may include an address and a telephone number;
– payment: as part of the payment for the products and services offered on the website, it records financial data relating to the user's bank account or credit card;
